Marital Vs. Non-Marital Property Marital property includes assets acquired during the marriage. Non-marital property is anything you received prior to the marriage or that belongs to you as an individual independent of the marriage.
Identifying what is marital and non-marital property can be challenging without the help of an experienced attorney. Even if a piece of property is titled in your name, such as a car, does not automatically make it non-marital property. Money you received during the marriage for a personal injury claim or an inheritance is considered non-marital property.
Minnesota law calls for the “just and equitable” distribution of the assets and debts and there are specific formulas for determining values.
